REAL ESTATE, SUBDIVISION ASSOCIATION AND CONSTRUCTION LAW

            The Cuddy & McCarthy Firm serves both public and private entities in the acquisition and sale, lease or exchange of real property, construction of institutional, commercial and residential property, as well as real estate litigation, eminent domain and condemnation proceedings.  The Cuddy & McCarthy Firm is experienced in handling related matters such as land use, zoning, condominiums, subdivision compliance and financing, taxation of mineral interests, water law and land conservation law, including bargain sales and charitable contributions of realty.

            The Firm represents numerous homeowners and neighborhood associations, including Eldorado’s Avila and Ladera Neighborhood Associations, the Las Campanas Owners’ Association, the Rancho Viejo North Community Association, and Park Plazas Community Services Association, in matters of zoning, subdividing, association development, collection of assessments and assessment lien foreclosures and covenant enforcement, as well as general legal matters. 

            Partner John Kennedy’s experience in this area exceeds two decades and spans all aspects of this representation, from creating the association itself, to updating outdated covenants, conditions and restrictions (CC&R’s) to assure that they address current needs of the members as the character of a growing community evolves.  The Cuddy & McCarthy Firm has also litigated many covenant enforcement actions on behalf of such associations to assure that the common scheme of development within the community intended by the CC&R’s is preserved.
